LIMITED GLASS WARRANTY AND REPLACEMENT PROCEDURES The CW Ohio, Inc. Webb window line insulating glass is warranted against failure of the hermetic seal for a period of 10 years from the date of manufacture. This limited warranty applies to all insulating glass manufactured after 1/1/92. Glass manufactured before this date continues to be covered with our 5-year limited warranty. CW Ohio insulating glass can be identified by the logo imprinted on the glass near the edge or stamped into the glass spacer. An example of the logo will read: Webb-IGI-3-90 (3-90 is the date of manufacture) or CW-JPG 92-1 (92-1 is the year and quarter of manufacture) CW Ohio, Inc.'s liability is limited to supplying replacement insulating glass, together with written instructions, to the CW distributor nearest the failure site or where the unit was purchased originally. The consumer is responsible for the removal and reinstallation of the glass and stops, any necessary repainting or refinishing, and all other matters associated with the replacement. This limited warranty does not cover broken glass or product failure caused by: improper installation, poor handling, excessive heat, sloped installation, stress due to structural movement, or chemical damage. CW Ohio, Inc. reserves the right to determine whether or not the seal is defective, and, at its request any failed unit must be returned to the factory for inspection. No other glass warranty is made by CW Ohio, Inc. No person is authorized to alter, extend or change this limited warranty without the specific written permission of CW Ohio, Inc. All claims under this warranty must be filed within thirty (30) days when the consumer discovers, or reasonably should have discovered, the alleged defect. Except for the above limited warranty, it is expressly agreed that no warranty of merchantability or of fitness for particular purpose or other warranty, expressed, implied or statutory, is made by CW Ohio, Inc. There are no warranties which extend beyond the description on the face hereof. This limited warranty is in Lieu of any other obligation or liability of CW Ohio, Inc. of any nature whatsoever, by reason of manufacturer, sale, or use of the covered products, and CW Ohio, Inc. neither assumes or authorizes anyone to assume for it any obligation of liability in the connection with said products. That is, rights, granted under this warranty shall be the sole and exclusive remedy whether in contract tort or otherwise, and CW Ohio, Inc. shall not be liable for injuries to persons or property, or for incidental or consequential damages or commercial losses nor for any other loss or damage excepting as set forth herein. All rights and remedies relating to this limited warranty shall be governed in accordance with the laws of the state of Oregon. |
